Terms of Service

1. Eligibility

You must be at least 12 years old to use the App. By using the App, you represent that you meet this age requirement. If you are under the age of majority in your jurisdiction, your parent or legal guardian must agree to these Terms on your behalf.

2. Your Account

• Anonymous accounts: You may use the App without signing in. An anonymous user ID is created to store your data locally and optionally in the cloud.
• Sign in with Apple: You may sign in with Apple to back up your stats to the cloud and join groups with friends.
• You are responsible for all activity under your account and for keeping your Apple ID secure.
• You must provide accurate information when you create a profile (display name).
• You may delete your account at any time from Settings → Profile → Delete Account.

3. User-Generated Content

The App lets you post content that is visible to other users, including display names, group names, group images, chat messages, and gameplay activity. You are solely responsible for the content you post.

3.1 Acceptable Use

You agree not to post content or engage in behavior that:

• Is illegal, harassing, threatening, or hateful.
• Is sexually explicit, pornographic, or exploitative.
• Contains slurs or targets any individual or group based on race, ethnicity, national origin, religion, gender, sexual orientation, disability, or similar characteristic.
• Impersonates any person or entity.
• Includes spam, scams, or unsolicited advertising.
• Infringes any copyright, trademark, or other intellectual property right.
• Contains viruses, malware, or any code designed to damage or disrupt the Service.
• Violates any applicable law or regulation.

3.2 Zero Tolerance for Objectionable Content

Birdie Tracker has a zero-tolerance policy for objectionable content or abusive users. We reserve the right, without notice, to:

• Remove or refuse to display any content.
• Suspend or terminate accounts that violate these Terms.
• Cooperate with law enforcement in response to serious violations.

3.3 Reporting

If you encounter objectionable content or abusive behavior, use the Report option on any chat message (long-press → Report). Reports are reviewed within 24 hours, and offending content or users will be removed.

3.4 Blocking

You may block any user to hide their messages from your view. Blocked users are not notified.

3.5 Your License to Us

By posting content in the App, you grant us a worldwide, non-exclusive, royalty-free license to host, store, display, and distribute that content as necessary to operate the Service and provide it to other users in your groups.

4. Subscriptions and Purchases

• Birdie Tracker Pro is an auto-renewing subscription processed by Apple.
• Payment is charged to your Apple ID at confirmation of purchase.
• The subscription automatically renews for the same term unless cancelled at least 24 hours before the end of the current period.
• Manage or cancel subscriptions in iOS Settings → Apple Account → Subscriptions.
• No refunds are issued for partial subscription periods.

5. Advertising

Free users see interstitial advertisements served by Google AdMob. Birdie Tracker Pro subscribers have an ad-free experience. Ads may be targeted using device identifiers; you can limit ad tracking in iOS Settings → Privacy & Security → Tracking.

6. Privacy

Your use of the App is also governed by our Privacy Policy, which explains how we collect and use your information.

7. Intellectual Property

The App, including its design, logo, and original content (excluding user-generated content), is owned by Birdie Tracker and protected by copyright, trademark, and other laws. You may not copy, modify, distribute, sell, or lease any part of the App without our written permission.

8. Third-Party Services

The App integrates with third-party services including:

• Google Firebase - authentication and cloud data storage
• Apple Sign-In - authentication
• RevenueCat - subscription management
• Google AdMob - advertising

These services are governed by their own terms and privacy policies. We are not responsible for the practices of third parties.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF DEALING.

We do not warrant that the App will be uninterrupted, secure, or error-free, or that it will meet your specific requirements.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BIRDIE TRACKER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, PROFITS, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.

OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE, OR $50, WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify and hold harmless Birdie Tracker from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms or your content posted in the App.

12. Termination

We may suspend or terminate your access to the App at any time, without notice, if you violate these Terms or engage in behavior harmful to other users or the Service. You may stop using the App at any time and delete your account from Settings.

13. Governing Law

These Terms are governed by the laws of the United States and the state of Minnesota without regard to conflict of law principles. Any dispute arising from these Terms shall be resolved in the state or federal courts located in Minnesota.

14. Changes to These Terms

We may modify these Terms from time to time. Material changes will be announced within the App and the "Last updated" date above will be revised. Continued use of the App after changes means you accept the updated Terms.

15. Apple End User License Agreement

These Terms are between you and Birdie Tracker, not Apple. Apple is not responsible for the App or its content. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple for a refund of the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the App. Apple is a third-party beneficiary of these Terms and may enforce them against you.
